She did not believe she was competent enough to consent.

The assessor advised that Miss Kelly be detained against her will. Miss Kelly was not keen to go to a unit and contacted her psychiatrist, Dr. Ramanathan Elayaperumal. He was a Consultant Psychiatrist with the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to the suggestion that was made, the Home Treatment Team performed a comprehensive evaluation on Miss Kelly’s current functioning and mental state. The review included an in-depth medical history as well as a physical exam. It also involved a detailed assessment of the psychological and family therapy and a psychiatric diagnostic assessment.

According to the report, Miss Kelly was suffering from a variety of mental health issues, such as borderline personality disorder, bulimia nervosa and anorexia nervosa. She had also been victimized by her husband and was an addict to drugs. Her symptoms were exacerbated by stress, anxiety, and depression. She was also diagnosed as having bipolar affective and schizoaffective disorder.

Elayaperumal claims that Medtronic deliberately discriminated against him because of his race and national origin. He claims that his poor performance review in June of 2000 as well as the decision not to give him certain projects assignments were influenced by racism. However there is no evidence to suggest that Medtronic’s decision-making was based on these factors. Elayaperumal’s lower performance score did not result in a reduction in his salary or benefits.
